Who we are

www.galleryofhumanmigration.org (the ” Website”, “Site”, “we”, or “us”) is owned and operated by the Gallery of Human Migration, Charitable Registration #88065 3902 RR0001. The Gallery of Human Migration is the data controller and can be contacted at: privacy@galleryofhumanmigration.org. We respect your privacy and are committed to protecting it through this Privacy Policy.

Purpose

The purpose of this privacy policy (this “Privacy Policy”) is to inform users of our Site of the following:

1. The Personal Data We Collect.

2. Use of collected data.

3. Who has access to the data collected, and

4. The rights of Site users.

 

This Privacy Policy applies in addition to the terms and conditions of our Site.

This Privacy Policy governs your access to and use of our Website, including any content, functionality and services offered on or through the Site. This policy applies to Personal Information we collect on the Website and in email, text, forms or other electronic messages between you and us.

Please read the Privacy Policy carefully before using the Website. By using the Website, you accept and agree to be bound by and abide by the Privacy Policy. You must not access or use the Website if you do not want to agree to the Privacy Policy.

Personal Information

“Personal information” under PIPEDA is any information that can be used to identify (or infer the identity of) a specific person, including, for example, your name, address, birth date, gender, etc. In some cases, your computer’s IP address can be considered personal information, as it may give some indication of your geographic location.

Consent

By using our Site, users agree that they consent to the conditions set out in this Privacy Policy. When the legal basis for us processing your data is that you have provided your consent to that processing, you may withdraw your consent at any time. If you withdraw your consent, it will not render unlawful the processing we completed before you withdrew your consent. You can withdraw your consent by contacting the Gallery at privacy@galleryofhumanmigration.org.

Why do we collect personal information?

There are a range of reasons why the Gallery may ask you for this information, including to process a donation or registration; to fulfill your subscription to an e-newsletter; to allow you to send letters; to invite you to events; or to provide other information about us which might interest you.

We may ask you for personal information in a variety of ways, including mail, email, website forms, surveys, mail-in forms, over the phone and in person, about opportunities to donate in support of our work.

The Gallery collects your information to record and support your participation in your selected activities. If you register to download a PDF or resources, sign up for our newsletter, and/or purchase a product from us, we collect your information. We use this information to track your preferences and to keep you informed about the products and services you have selected to receive and any related products and/or services.

How do we collect personal information?

We collect personal information only by lawful and fair means and only collect personal information that is reasonably necessary for the legitimate purposes identified and for which consent has been obtained. 

Information you provide to us

The Website provides various places for users to provide information. We collect information that users provide by filling out forms on the Website, communicating with us via contact forms, responding to surveys, searching queries on our search feature, and providing information when ordering a product or service via the Website. We use information you provide to us to deliver the requested product and/or service, to improve our overall performance, and to provide you with offers, promotions, and information.

Your choice to provide us with your personal information is at your discretion. You may always elect to withhold information. In some cases, we will require your personal information to fulfill something you’ve asked of us. For example, when you donate, we’re required by law to take your full name and mailing address to send you a tax-deductible receipt. 

Donation and credit card information

You may need to provide your credit card information to make your donation.

If you make an online donation, we won’t store your credit card information. Instead, it’s collected and processed by a third-party service provider – Zeffy – a certified B Corporation, https://www.zeffy.com/home/about-us, which either processes your single gift or stores your data to be processed each month.

About fundraising

As a registered Canadian charity, we cannot do our work without the financial support of our many generous donors. We do our best to reach out to as many individual supporters as we can. Our donors allow us to maintain our independence.

We may use the information you provide (such as your postal code) to find more complete contact information from other sources (such as Canada Post) so we can reach out to you, and we may use third-party providers to help. The chance to send you a letter or give you a phone call helps us see if we’re a good fit for you when it comes to making donations. You may opt out of these communications at any time by contacting donation@galleryofhumanmigration.org

Our websites may contain links to websites owned and operated by other organizations. They may have their privacy policies, terms and conditions and are not governed by this policy. We encourage you to carefully review the privacy policy and terms of use of each website you visit.

Retention of your information

Unless otherwise permitted or required by applicable laws or regulations, we will retain your personal information only as long as necessary to fulfill the purposes for which it was collected, including to satisfy CRA, legal, accounting or auditing requirements.

Information we collect through automatic tracking technology

As you navigate through our Site, we may use automatic data collection technologies, including Google Analytics, Google Tag Manager and Active Campaign, to collect certain information about your equipment, browsing actions, and patterns. This will generally include information about your location, traffic patterns through our Site, and any communications between your computer and our Site.  Among other things, we will collect data about the type of computer you use, your Internet connection, your IP address, your operating system, and your browser type. 

The information we collect automatically is used for statistical data and will not include personal information. We use this data to improve our Site and our service offerings. To the extent that you voluntarily provide personal information to us, our systems will associate the automatically collected information with your personal information.

Use of cookies and pixels

We utilize a standard technology called “cookies” and server logs to collect information about how our site is used. Information gathered through cookies and server logs may include the date and time of visits, the pages viewed, time spent at our site, websites visited just before and after our own, as well as your IP address. One of the primary purposes of cookies is to provide a convenience feature to save you time. For example, if you personalize a web page or navigate within a site, a cookie helps the site to recall your specific information on subsequent visits. Hence, this simplifies the process of delivering relevant content and eases site navigation by providing and saving your preferences and login information, as well as providing personalized functionality. The Gallery reserves the right to use technological equivalents of cookies, including social media pixels. These pixels allow social media sites to track visitors to outside websites to tailor advertising messages users see while visiting that social media website. The Gallery reserves the right to use these pixels in compliance with the policies of the various social media sites.​

Third-party use of cookies

Some content or applications, including advertisements, on the Website are served by third parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our website. The information they collect may be associated with your personal information, or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioural) advertising or other targeted content.

Information we share

We sometimes send personal information to outside organizations who help us better communicate with you. We only work with organizations that have comprehensive security and confidentiality policies, including written policies that do not allow them to use or share your information with anyone other than the Gallery.

We may disclose information to other third-party service providers that perform services on our behalf, such as payment processing, marketing, information technology, data hosting and processing services.

Finally, we may disclose personal information as necessary to meet legal, regulatory, insurance, audit, and security requirements, and as otherwise with your consent, or as permitted or required by law (including as required by applicable Canadian and foreign laws applicable to us or our service providers).

Email information

If you choose to correspond with us through email, we may retain the content of your email messages together with your email address and our responses. We provide the same protections for these electronic communications that we employ in the maintenance of information received online, by mail, and by telephone. Email policies

We are committed to keeping your e-mail address confidential. We do not sell, rent, or lease our subscription lists to third parties, and will not disclose your email address to any third parties except as required by law. All e-mails sent by us will be in compliance with the Canadian Anti-Spam Legislation (“CASL”), including clearly stating who the e-mail is from and providing clear information on how to contact the sender. In addition, all e-mail messages will also contain concise information on how to remove yourself from our mailing list so that you receive no further e-mail communication from us.  Users who no longer wish to receive our newsletter or promotional materials may opt-out of receiving these communications by clicking on the unsubscribe link in the email.

How do we use your information?

We use personal information for purposes of presenting our Website and its contents to you, providing you with information, providing you with offers for products and services, providing you with information about your subscriptions and products, carrying out any contract between you and us, administering our activities, providing customer service, and making available other items and services to our customers and prospective customers. 

From time-to-time, we may use the information you provide to us to make you offers to purchase products and services provided by third parties in exchange for a commission to be paid to us by such third parties. Should you opt to take part in such promotions, the third parties will receive your information. 

From time-to-time, we may use the information you provide to us to display advertisements to you that are tailored to your personal characteristics, interests, and activities.

Disclosure of information

As a general rule, we do not sell, rent, lease or otherwise transfer any information collected either automatically or through your voluntary action. We may disclose your personal information to our subsidiaries, affiliates, and service providers to provide our services to you. We may disclose your personal information to a third party, including a lawyer or collection agency, when necessary to enforce our terms of service or any other agreement between you and us. We may disclose information when legally compelled to do so, when we, in good faith, believe that the law requires it, or for the protection of our legal rights, or when compelled by a court or other governmental entity to do so.

We use appropriate security measures to protect against loss, theft, unauthorized access, disclosure, use or modification of personal information. Such measures will vary depending on the sensitivity, amount, format, nature, and storage of the personal information and will involve, as applicable, physical, organizational, and electronic security measures, including premises security, restricted file access, technological safeguards including security software and firewalls to prevent unauthorized computer access, and password and security policies.  In communicating with us, you should be aware that e-mail is not a fully secure medium.

Updating information and correcting errors

Since we use your personal information to provide goods or services to you, the information must be accurate and up to date.  If any of your information changes, is inaccurate or incomplete, please inform us so that we can make any necessary changes at privacy@galleryofhumanmigration.org

Access to personal information

We will respond promptly to any request for access to your personal information and will advise you of the cost, if any, before the retrieval of such records or information. We will not respond to requests for access to personal information that are frivolous, vexatious, or repetitious.  In certain circumstances, we may be unable to provide access to some or all of the personal information that we hold about you.

Cross-border transfer of information (visitor gdpr)

Some information we collect may be stored and processed on servers located outside your jurisdiction of residence, including outside your province and/or country. Please note that the privacy laws in such jurisdictions may differ from Canadian privacy laws.  As a result, this information may be subject to disclosure to governments, courts or law enforcement agencies in those areas, according to their laws, without notice to us or you.
